High Court rejects petition seeking directions to summon Chief Minister Narendra Modi before Nananavati Commission

Gujarat High Court on Wednesday rejected the petition filed by Jan Sangharsh Manch (JSM) seeking directions to Nanavati Commission to summon the Chief minister Narendra Modi and question him on post-Godhra riots.
While rejecting the petition, a division bench comprising Justice Akil Kureshi and Justice Sonia Gokani observed that they did not find any substance in the plea.
The court, declined to interfere with the Commission’s proceedings, saying inquiry was yet to conclude and it cannot be subjected to judicial scrutiny at this stage.
“At this stage, even before completion of proceedings of the Commission, we do not find that its tentative conclusions are open to judicial scrutiny... we are not inclined to interfere, at least at this stage,” the judges noted.
Jan Sangharsh Manch representing the riot victims had approached the court seeking directions to the Commission to call Modi for questioning after the Commission of Justice G T Nanavati and Justice Akshay Mehta, probing the 2002 riot cases had rejected its application on the issue.
Petitioners to move SC
Responding to the judgment lawyer and activist Mukul Sinha, who filed the petition said he will challenge the order before the Supreme Court.
“We will move the apex court on this issue. It is only proper that Modi should have deposed before the Commission,” said lawyer and activist, Mukul Sinha, who filed the petition.
SIT chief protecting CM in riots case: Gohil
Leader of the Opposition in Gujarat Legislative Assembly Shaktisinh Gohil on Wednesday accused SIT chief Raghavan of protecting Chief Minister Narendra Modi in the communal riots case. Gohil alleged that Raghavan’s conduct has always been suspicious. The SIT chief has been extended undue facilities by the Modi government that pays him Rs 1.5 lakh every month from the public money. The Supreme Court had asked Raghavan to submit the report by September 12, 2011, but he delayed the same, Gohil claimed. He added that Raghavan was extended facilities at government expense during his visit to the UK.
He accused Raghavan of not recording statements of importnt witnesses like R B Sreekumar, Rahul Sharma and Sanjiv Bhatt, claiming Raghavan is trying to find loopholes in the report filed by Amicus Curiae Raju Ramchandran who had hinted at the presence of ministers in control rooms and the presence of Sanjiv Bhatt at the residence of Modi.
Gohil claimed that Raghavan was associated with the Tata Group that has been doled out incentives worth crores by the Modi government in the Nano project.
